These Terms of Service (“Terms”) govern your purchase of and participation in The Daily Pact. The Daily Pact is a brand operated by Pure Wellness Counseling LLC (“The Daily Pact,” “we,” “us,” or “our”). By purchasing a subscription, creating an account, or using the service, you agree to these Terms.

1. What The Daily Pact Is

The Daily Pact is a paid, non-clinical behavioral follow-through platform focused on daily accountability, educational frameworks, masterclasses, and community support. The service may include the daily MAKE → ACCOUNT → RETURN tracking system, daily prompt and mission videos, weekly masterclasses and trainings, community forums, and educational materials.

Important Medical & Clinical Notice: The Daily Pact is not therapy, psychotherapy, clinical mental-health counseling, medical care, psychiatric care, addiction treatment, eating-disorder treatment, diagnosis, or crisis support. Participation does not create a therapist-client or other clinical treatment relationship with Jacob Fletcher, CMHC, Pure Wellness Counseling LLC, Logan Cramer, or any other team member.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement where you live to join The Daily Pact.

3. Your Account

  • Your account and access are personal to you and may not be shared, assigned, or transferred.
  • You agree not to share your login credentials or provide any non-member access to member-only platforms, videos, frameworks, or community feeds.
  • You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account.
  • You agree to provide accurate, current billing and contact details and update them promptly if they change.

4. Subscriptions, Pricing, Free Trials, and Automatic Renewal

The Daily Pact is offered as an automatically renewing recurring subscription until canceled:

  • Monthly Plan: Billed at $97 per month. The monthly plan includes a 14-day free trial ($0 today). If you do not cancel before Day 14, your payment method on file will be charged $97 at the end of the 14-day trial, and every month thereafter until canceled.
  • Annual Plan: Billed at $970 per year. The annual plan is paid immediately at checkout and has no free trial. It includes two months free compared to the monthly plan and includes a private 1-on-1 setup session with Jake Fletcher. It renews automatically every 12 months at the then-current annual rate until canceled.

If you signed up under a qualified promotional founding rate (such as $47/month or $470/year), that rate remains locked only while your subscription remains continuously active. If canceled, the founding rate is forfeited, and any future resubscription will be at the standard rate in effect at that time.

All prices are stated in U.S. dollars unless explicitly indicated otherwise at checkout. By purchasing, you authorize us and our third-party payment processors (e.g., Stripe, HighLevel) to charge your payment method on a recurring basis until you cancel.

5. Cancellation

You may cancel your subscription at any time directly through the customer billing portal provided in your confirmation emails or inside the app, or by contacting our team at [email protected].

  • Monthly Trial Cancellations: If you cancel during your 14-day free trial, you will not be charged.
  • Standard Cancellations: For active paid memberships, cancellation takes effect at the end of your current paid billing period (monthly or annual). You maintain full access to member tools and resources until the end of that period, and no further recurring charges will be made.

6. Failed Payments

If your scheduled recurring payment fails, we or our payment processor may attempt to re-bill the card on file and will notify you to update your billing details. If payment cannot be processed, access to The Daily Pact platform and community will be suspended until resolved.

7. Refunds and the 30-Day Money-Back Guarantee

Our 30-Day Guarantee: If you do not like The Daily Pact for any reason, you may request a 100% full refund within 30 calendar days of your initial purchase (applicable to both monthly subscriptions and annual subscriptions). No hoops, no mandatory posting proof, and no guilt trips. Simply email [email protected] within 30 days of purchase.

After the initial 30-day guarantee period, membership payments are non-refundable for elapsed time, but you may cancel anytime to prevent future billing. Our complete terms are set forth in our Refund & Cancellation Policy, which is incorporated into these Terms.

8. Your Content and Community Posts

You retain ownership of any journal entries, comments, questions, or content you submit. By sharing content in the community or live sessions, you grant Pure Wellness Counseling LLC a non-exclusive, worldwide, royalty-free license to store, display, and process that content as necessary to operate the service.

We respect your privacy: we will never use your personal member posts, private check-in records, likeness, or story in public marketing without your explicit separate consent.

9. Community Conduct

To preserve a supportive, anti-perfectionist environment, all members agree not to:

  • Harass, threaten, demean, shame, or discriminate against any member;
  • Capture, screenshot, or share another member’s personal check-ins, discussions, or identity outside the community;
  • Solicit, spam, recruit, or pitch products or services to members without authorization;
  • Post unlawful, sexually explicit, hateful, or harmful content;
  • Provide unauthorized medical, psychological, legal, or financial professional advice;
  • Scrape, reverse-engineer, exploit, or share login access to the software or training materials;
  • Resell, redistribute, or teach our proprietary frameworks and materials without express written authorization.

10. Live Masterclasses, Workshops, and Recordings

Weekly live trainings and masterclasses (including Wednesday sessions) are recorded and uploaded to the member replay vault. By attending a live session, you understand that your voice, camera feed, display name, and chat messages may be recorded and made available to current members.

If you prefer not to appear in session recordings, keep your microphone and camera turned off and submit any questions anonymously via chat or the member prompt form.

11. Jacob Fletcher’s Professional Role

Jacob Fletcher, CMHC, is a Licensed Clinical Mental Health Counselor and Certified Clinical Hypnotherapist. Within The Daily Pact, Jake participates strictly in an educational, behavioral training, and facilitation capacity. He does not provide clinical mental health counseling, psychotherapy, diagnosis, hypnotherapy, or clinical treatment plans through The Daily Pact.

If you are or become an individual clinical client of Pure Wellness Counseling LLC, that clinical relationship is governed entirely by separate clinical documentation and communication channels. The Daily Pact is never a substitute for clinical care.

12. No Guaranteed Results or Earnings

We provide frameworks, daily tracking software, and accountability. We do not and cannot guarantee specific health, fitness, financial, personal, or business outcomes. Any income or results shared through our THRIVE ecosystem or member stories reflect individual effort and circumstances; they are not typical and are not promises of earnings.

13. Health, Wellness, and Safety

The Daily Pact discusses lifestyle routines involving movement, nutrition, work habits, and sleep. None of this material constitutes individual medical advice. Consult your physician or licensed healthcare provider before undertaking significant dietary or physical training changes.

14. Crisis Support Notice

The Daily Pact is not monitored for crises and is not an emergency service. If you are experiencing thoughts of self-harm, medical emergency, or personal danger, contact local emergency services immediately. In the U.S., call or text 988 to reach the Suicide & Crisis Lifeline.

15. Intellectual Property

The Daily Pact name, logos, MAKE → ACCOUNT → RETURN system, Pact90, framework modules, daily missions, and written guides are proprietary assets of Pure Wellness Counseling LLC. You receive a limited, personal, non-transferable license to use these materials solely for your own personal development during your active membership.

16. Third-Party Infrastructure

The Daily Pact utilizes reliable third-party infrastructure (such as Stripe, HighLevel, GoKollab, and cloud hosting providers). We are not liable for technical outages, interruptions, or data practices of these external vendors outside our reasonable control.

17. Termination by Us

We reserve the right to suspend or terminate access for members who violate community conduct rules, share credentials, pirate materials, or engage in unlawful behavior. In cases of severe breach (such as harassment or copyright theft), termination is immediate and without refund.

18. Limitation of Liability

To the maximum extent allowed by applicable law, Pure Wellness Counseling LLC’s total aggregate liability arising out of your participation in The Daily Pact will not exceed the total amount paid by you for the service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, punitive, or consequential damages.

19. Governing Law and Dispute Resolution

If any dispute arises, you agree to contact us first at [email protected] and allow our small team 24 to 48 business hours to work with you in good faith to resolve the matter informally.

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to conflict-of-law principles. Any legal proceeding arising under these Terms shall be instituted exclusively in the state or federal courts located in Utah.
